1. Agreement to Terms

These Terms and Conditions ("Terms", "Terms and Conditions") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Unitect LLC ("Company", "we", "us", or "our"), concerning your access to and use of the Hashifix mobile application, website, and related services (collectively, the "Service").

By accessing or using our Service, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Service and you must discontinue use immediately.

2. Medical Disclaimer

IMPORTANT: THE SERVICE IS NOT INTENDED TO PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The Hashifix application and its AI chatbot are designed to provide general information and educational content about thyroid health. The Service is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Never disregard professional medical advice or delay in seeking it because of something you have read or learned through the Service.

The AI chatbot responses are generated by artificial intelligence and may contain errors, inaccuracies, or outdated information. The Service does not:

- Provide medical diagnoses

- Prescribe medications

- Replace professional medical consultation

- Guarantee the accuracy of health information provided

You acknowledge and agree that:

- Any information provided by the Service is for informational purposes only

- You will consult with qualified healthcare professionals for medical decisions

- We are not responsible for any health outcomes resulting from your use of the Service

- The Service may not be suitable for all individuals or medical conditions

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

- You are at least 18 years old

- You have the legal capacity to enter into these Terms

- You will comply with all applicable laws and regulations

- All information you provide is accurate and truthful

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Service, you must register for an account. You agree to:

- Fraudulent, abusive, or illegal activity

- Misuse of the Service

- Failure to pay any fees owed (if applicable)

5. Use of the Service

5.1 Permitted Use

You may use the Service for lawful purposes only and in accordance with these Terms. You agree to:

- Use the Service in compliance with all applicable laws and regulations

- Respect the intellectual property rights of others

- Not interfere with or disrupt the Service or servers

- Not attempt to gain unauthorized access to any portion of the Service

5.2 Prohibited Uses

You agree not to:

- Use the Service for any illegal purpose or in violation of any laws

- Transmit any harmful code, viruses, or malicious software

- Attempt to reverse engineer, decompile, or disassemble the Service

- Use automated systems (bots, scrapers) to access the Service

- Impersonate any person or entity

- Harass, abuse, or harm other users

- Upload content that is illegal, harmful, or violates others' rights

- Exceed the daily question limit through any means, including creating multiple accounts

5.3 Daily Limits

The Service includes a daily limit on the number of questions you may ask the AI chatbot. This limit is enforced to ensure fair usage and system stability. Attempts to circumvent this limit are prohibited.

6. User Content and File Uploads

6.1 Content You Provide

You retain ownership of any content, files, images, or information you upload or submit through the Service ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

- Use, store, and process your User Content to provide the Service

- Share your User Content with third-party service providers (e.g., OpenAI, Cloudinary) necessary to operate the Service

- Use your User Content for improving and maintaining the Service

6.2 File Uploads

When you upload files (images, documents, lab results) through the Service:

- Files are processed and analyzed by our AI service provider (OpenAI)

- Files may be temporarily stored on third-party servers (Cloudinary) for processing

- We do not use your uploaded files for training AI models without your explicit consent

- You are responsible for ensuring you have the right to upload and share any files you submit

6.3 Prohibited Content

You agree not to upload any User Content that:

- Contains personal health information of others without their consent

- Violates any laws or regulations

- Infringes on intellectual property rights

- Contains malicious code or viruses

- Is offensive, defamatory, or harmful

7. Intellectual Property Rights

7.1 Our Rights

The Service, including its original content, features, functionality, design, and software, is owned by Unitect LLC and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.

8. Third-Party Services

The Service integrates with third-party services, including:

- Clerk: Authentication and user management

- OpenAI: AI chatbot functionality

- Cloudinary: File storage and processing

- PostHog: Analytics and user behavior tracking

- Sentry: Error tracking and monitoring

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third-party services.

9. eBook Purchase

If you purchase an eBook through the Service:

- All sales are final unless otherwise stated

- Refunds are subject to our refund policy (if applicable)

- The eBook is provided for your personal, non-commercial use

- You may not redistribute, resell, or share the eBook with others

- Digital rights management may apply

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- WARRANTIES OF MERCHANTABILITY

- FITNESS FOR A PARTICULAR PURPOSE

- NON-INFRINGEMENT

- ACCURACY, RELIABILITY, OR COMPLETENESS OF INFORMATION

- UNINTERRUPTED OR ERROR-FREE OPERATION

We do not warrant that:

- The Service will meet your requirements

- The Service will be available at all times

- Errors will be corrected

- The Service is free of viruses or other harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL UNITECT LLC, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR:

- ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES

- ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES

- ANY DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE SERVICE

- ANY DAMAGES RESULTING FROM RELIANCE ON INFORMATION PROVIDED BY THE SERVICE

- ANY HEALTH-RELATED OUTCOMES RESULTING FROM USE OF THE SERVICE

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Unitect LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorney's fees and costs, arising out of or in any way connected with:

- Your access to or use of the Service

- Your violation of these Terms

- Your violation of any third-party right, including any intellectual property or privacy right

- Any User Content you submit or transmit through the Service

13. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

14. Modifications to the Service

We reserve the right to:

- Modify or discontinue the Service (or any part thereof) at any time

- Change, suspend, or discontinue any features or functionality

- Impose limits on certain features or restrict access to parts of the Service

- Update these Terms at any time

We will notify you of any material changes to these Terms by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.

15. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

- Your right to use the Service will immediately cease

- We may delete your account and data

- All provisions of these Terms that by their nature should survive termination shall survive

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Sheridan County, Wyoming.

17. Dispute Resolution

17.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at Contact@unitect.com.

17.2 Binding Arbitration

If we cannot resolve a dispute informally, you agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Sheridan County, Wyoming.

18. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unitect LLC regarding the Service and supersede all prior agreements and understandings.
