These Terms and Conditions ("Terms") govern your use of the Hashifix mobile application and related services (the "Service") operated by Unitect LLC ("Company", "we", "us", or "our").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. Users between 13 and 17 must have parental or guardian consent. By using the Service, you represent and warrant that you meet this requirement.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Use of the Service

3.1 Permitted Use

The Service is provided for personal, non-commercial use. You may use the Service to:

• Access the AI thyroid health assistant for informational purposes
• Upload and store thyroid lab results
• Track your thyroid health data over time
• Access educational content related to thyroid health

3.2 Lab Result Features

Understand My Results (on-device feature): When you use the "Understand My Results" feature, your lab values are compared against published reference ranges entirely on your device. No data of any kind is sent to our servers, to OpenAI, or to any third party. Your lab result photo is never uploaded anywhere — all text recognition is performed on-device. Personal identifiers (name, date of birth, doctor, facility) are never extracted or stored.

AI Assistant: The AI thyroid health assistant is a separate feature that connects to OpenAI's API. Before using the AI assistant for the first time, you will be shown a mandatory disclaimer confirming that the service is for educational purposes only. If you choose to include anonymous lab values in your AI assistant conversation, only those anonymous numeric values (test name, numeric result, reference range) are transmitted to OpenAI — never photos, personal identifiers, or account information. By using the AI assistant, you acknowledge and consent to the following:

• Educational purpose only: Responses from the AI assistant are for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider to interpret your results.
• No personal conclusions: The AI assistant will not draw personal conclusions about your health, diagnose conditions, or assess the likelihood of any medical condition based on your values. It will compare values to published reference ranges and provide general educational context only.
• OpenAI processing: Chat messages and any anonymous lab values you include are processed by OpenAI under a Data Processing Agreement. OpenAI does not use API data to train its models. See our Privacy Policy for full details.

3.3 Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any regulations
• Attempt to gain unauthorized access to any part of the Service or its systems
• Upload malicious content, viruses, or harmful code
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to harass, abuse, or harm others
• Scrape, crawl, or otherwise extract data from the Service
• Use automated systems or bots to interact with the Service
• Share your account credentials with others
• Resell or commercially exploit the Service or its content

4. Medical Disclaimer

IMPORTANT: The Hashifix Service is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Specifically:

• The AI assistant provides general information about thyroid health and should not be interpreted as medical advice
• The Hashifix Score is a personal tracking index based on a disclosed formula comparing your values to published reference ranges — it is not a clinical measurement, diagnostic tool, or health assessment
• Lab result tracking is a tool for personal awareness, not clinical diagnosis
• Always consult a qualified healthcare provider before making any medical decisions
• Never disregard professional medical advice or delay seeking it because of something you read or received through the Service
• In a medical emergency, call your local emergency services immediately

We are not responsible for any decisions made based on information provided by the Service.

5. Usage Limits

The Service may impose usage limits on certain features, including but not limited to:

• A daily limit on AI assistant messages (currently 25 messages per day for free accounts)
• File upload size limits
• Storage limits for lab results

We reserve the right to modify these limits at any time. Continued use of the Service after such changes constitutes acceptance of the new limits.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Unitect LLC and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of content you upload to the Service (e.g., lab result documents). By uploading content, you grant us a limited, non-exclusive license to process and display that content solely for the purpose of providing the Service to you.

You may not copy, modify, distribute, sell, or lease any part of the Service without our explicit written permission.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

8. Third-Party Services

The Service integrates with third-party services including OpenAI, Clerk, PostHog, and Sentry. Your use of these integrations is subject to the respective terms and privacy policies of those providers. We are not responsible for the actions, content, or practices of third-party services.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Any information provided through the Service is accurate, complete, or reliable
• The Service will meet your requirements
• Any defects in the Service will be corrected

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNITECT LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim (or $100 if you have not made any payments).

10. Indemnification

You agree to indemnify, defend, and hold harmless Unitect LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or submit through the Service

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or for any other reason at our sole discretion.

You may delete your account at any time through the Account tab in the app. Upon termination, your right to use the Service ceases immediately.

Sections 4, 6, 9, 10, and 12 of these Terms survive termination.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration in Sheridan, Wyoming, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

You waive any right to participate in a class-action lawsuit or class-wide arbitration.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last Updated" date. For significant changes, we will provide notice via email or an in-app notification.

Continued use of the Service after changes to the Terms constitutes your acceptance of the updated Terms.
